Known as the Five Percent Safe Harbor Test, this method requires incurring at least 5% of the project’s total cost on qualifying equipment (e.g., solar panels, racking, inverters).
The exact requirements depend on the project owner’s accounting method, but typically title transfer of the equipment must occur within the qualifying year.
While 5% is the minimum, many developers recommend purchasing solar panels (often the largest cost component) to both secure equipment pricing and ensure compliance.
Begin Physical Work of a Significant Nature
Alternatively, a project qualifies if meaningful construction activities—such as excavation, foundation work, or equipment assembly—begin before the deadline.
Preliminary activities like permitting, financing, or site surveys do not qualify.
